Background: The use of restorative justice in corruption cases remains contested. Attorney General’s Circular (SE JAMPIDSUS) No. B-1113/F/Fd.1/05/2010 permits prosecutors to forgo low-value cases once the losses are repaid, yet Article 4 of the Anti-Corruption Law states that restitution does not extinguish criminal liability. Inconsistent practice undermines equality before the law, while studies from an Islamic legal perspective are still scarce. Objective: This article examines how Islamic law constructs the handling of corruption, identifies how restorative justice is applied in corruption cases, and assesses its relevance to the circular. Methods: This normative-doctrinal legal study adopts a qualitative design with conceptual and statutory approaches. Primary, secondary, and tertiary legal materials were gathered through library research and analyzed using grammatical, systematic, and teleological interpretation within the framework of maqāṣid al-sharī‘ah. Results: Corruption falls under jarīmah ta‘zīr. The circular specifies no threshold for minor losses, no offender criteria, and no oversight mechanism, so the reviewed rulings treat restitution merely as a mitigating factor. Discussion: The relevance of Islamic law is conditional, since procedural efficiency (ḥājiyyāt) cannot override the protection of public wealth (ḍarūriyyāt). The study proposes a limited and selective restorative justice model that combines full restitution, ta‘zīr sanctions, and supervised prosecutorial discretion.
